Amendment to Section 176(3) of the Ontario Highway Traffic Act – School Crossings
Approved at the 51st Annual General meeting held June 19, 2002
WHEREAS Section 176(3) of the Ontario Highway Traffic Act deals with the need for the driver of a vehicle or streetcar approaching a school crossing where a stop sign is displayed, to stop before reaching the crossing, this section does not control when the vehicle or streetcar may proceed through the school crossing;
WHEREAS other sections of the Ontario Highway Traffic Act dealing with stop signs and traffic signals specifically identify when a vehicle may proceed through an intersection;
WHEREAS onus must be placed on the drivers not to proceed too early through a school crossing where a crossing guard displays a stop sign;
THEREFORE BE IT RESOLVED that the Ontario Association of Chiefs of Police urge the Provincial Government of Ontario to amend the Highway Traffic Act to ensure that crossing guards maintain the stop sign in the upright position until the children and the crossing guard have left the road and further that vehicles not be allowed to proceed until the sign is lowered.
